Terms of Use

These terms govern your access to and use of the KodaLand website and platform (the “Service”). By requesting access to or using the Service, you agree to these terms. If you do not agree, do not use the Service.
1. Private, invitation-only access
KodaLand is a private platform offered by invitation. Access is granted at our discretion and may be limited, suspended, or revoked at any time. You are responsible for keeping your access credentials confidential and for all activity under your account. Do not share access, and notify us promptly of any unauthorized use.
2. Permitted use
You may use the Service only for your own lawful, professional land-evaluation purposes and in accordance with these terms. You agree not to:
- Copy, scrape, resell, sublicense, or redistribute the Service or its data except as expressly permitted;
- Attempt to bypass access controls, probe or test the security of the Service without authorization, or interfere with its normal operation;
- Use the Service to violate any law, third-party right, or applicable data-use restriction; or
- Misrepresent your identity or your authorization to access the Service.
3. Information is for evaluation, not advice
The Service compiles and organizes information drawn largely from public records and other third-party sources. It is provided to help you evaluate land and decide what to look into further. It is informational only and is not legal, title, survey, engineering, environmental, tax, appraisal, or financial advice, and it is not a substitute for professional diligence. Public records can be incomplete, out of date, or inaccurate, and coverage varies by source. Where a source has no data, the Service is designed to show that gap rather than fill it with a guess — but you remain responsible for independently verifying anything you rely on before making a decision.
4. No warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information will be complete or current.
5. Limitation of liability
To the maximum extent permitted by law, KodaLand and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost business, or lost data, arising out of or relating to your use of — or inability to use — the Service, even if advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under applicable law.
6. Intellectual property
The Service, including its software, design, text, and compiled presentations of data, is owned by KodaLand and protected by applicable law. Underlying public records remain the property of their respective sources. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for the permitted purposes above; no other rights are granted.
7. Third-party services
The Service is delivered through third-party infrastructure, including Cloudflare, and relies on data from public and third-party sources. We are not responsible for those third parties’ services or content, and your use of them may be subject to their own terms.
8. Changes
We may modify the Service or these terms from time to time. When we change these terms, we will update the “Last updated” date above. Your continued use of the Service after a change takes effect constitutes acceptance of the updated terms.
9. Termination
We may suspend or terminate your access at any time, with or without notice, including for any violation of these terms. Sections that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — will survive.
10. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. The exclusive venue for any dispute will be the state or federal courts located in Texas, to the extent permitted by law.
